&lt;p&gt;Because of this, I&amp;#39;m very familiar with helping my customers who have financial problems. Many of them are struggling to buy groceries, keep the power turned on, and pay for gas to get to work. They&amp;#39;re struggling to pay for the necessities just to survive and feed their families.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;In most cases they&amp;#39;ve missed payments on credit cards. The credit card companies think you should pay them before you buy groceries.&lt;/strong&gt; If you&amp;#39;re in this situation, then do not give a dime of your money to any credit card company.&lt;/p&gt;

&lt;p&gt;A credit card is an unsecured debt. The companies that issue them don&amp;#39;t have any collateral to get their money back. They can&amp;#39;t come get your car or take your house.&lt;/p&gt;

&lt;p&gt;Because of that, they cram hundreds of people into cubicles and &amp;quot;sic &amp;#39;em&amp;quot; on people in financial difficulty. They make hundreds of calls each day, lying and threatening people to scare them into paying.&lt;/p&gt;

&lt;p&gt;If you&amp;#39;re having financial problems, then just take a break from these people. Get them off the phone as quickly as possible. Hang up if the conversation has gone longer than 30 seconds.&lt;/p&gt;

&lt;p&gt;Don&amp;#39;t believe any threats to sue you. I estimate that 90% of the threats to sue are never carried out. Even if they do sue and get a judgment, they can garnish only 25% of your wages. I estimate that 95% of all unpaid credit cards will never result in a wage garnishment.&lt;/p&gt;

&lt;p&gt;Now, I&amp;#39;m not saying you shouldn&amp;#39;t pay these companies. But get your life back on track before you do. Get all the necessities paid for first. Every other payment should be caught up before you pay them a dime. You should also have an emergency fund of $1000 or more before you pay them. Your kids, healthcare for the entire family, and all other necessary expenses should be taken care of. If your car is having problems and needs to be replaced, then buy a new car.&lt;/p&gt;

&lt;p&gt;Once you have everything in order financially, you can start working with the past due credit cards. But don&amp;#39;t just pay them off in full. Most of them will accept 10-20% of the original balance. Pay them what you think is fair. When paying them off, never send them a check or give them your debit card info.&lt;/p&gt;

&lt;p&gt;Some of their contracts have clauses that allow them to charge you more than you had agreed on the phone. Get everything signed and in writing. Then mail them an untraceable payment method like a money order. That way they can&amp;#39;t take every dime out of your bank account.&lt;/p&gt;

It discussed how Bank of America recently came out with new short sale incentives.&lt;/p&gt;

&lt;p&gt;Bank of America is willing to pay borrowers up to $30,000 for moving expenses to short sale their homes. I doubt many homeowners will receive $30,000; most will receive the lower amount of $2500.&lt;/p&gt;

&lt;p&gt;But that&amp;#39;s still better than repaying your lender thousands of dollars for its loss. As you can see, banks like short sales. But why is that?&lt;/p&gt;

&lt;p&gt;It comes down to one simple thing: money. The banks have foreclosed on thousands of properties. They have also assisted with thousands of short sales. Over time they realized that selling a property as a short sale usually nets them more money.&lt;/p&gt; 

&lt;p&gt;Here&amp;#39;s an example. We had a home for sale as a short sale. A buyer offered to buy the home for $275,000.&lt;/p&gt;

&lt;p&gt;The bank reviewed the offer and turned it down, thinking the house was worth more than that. We tried and tried to convince the lender to accept the offer. But the bank wouldn&amp;#39;t accept it.&lt;/p&gt;

&lt;p&gt;So we put the property back on the market. The market continued to decline. We submitted all the new offers to the lender. However, the bank continued to turn them down.&lt;/p&gt;

&lt;p&gt;Finally, 18 months later, the bank accepted an offer. But this time the house was selling for $235,000.&lt;/p&gt;

&lt;p&gt;I&amp;#39;m sure that shocks you. What?!? That lender just lost $40,000! Wouldn&amp;#39;t someone be angry? No. No one is angry. That&amp;#39;s crazy, isn&amp;#39;t it?&lt;/p&gt;

&lt;p&gt;But it&amp;#39;s just part of life for these lenders. They have to make decisions every day. They&amp;#39;re used to losing money on foreclosures and short sales. They have seen this story before on many other homes. Overall, they know that short sale will net them more money than a foreclosure. As a result, they prefer short sales over a foreclosure.&lt;/p&gt;

&lt;p&gt;The good news is that very few people will get sued. The vast majority of all short sale sellers will be released from the debt as a condition of the short sale.&lt;/p&gt;

&lt;p&gt;We have reviewed hundreds of short sale approval letters and are familiar with the laws in different states. We estimate that 85-90% of all short sales will be approved with the deficiency being waived.&lt;/p&gt;

&lt;p&gt;But what about the remaining people? There are several reasons they&amp;#39;re unlikely to be sued. Remember, in most cases they can&amp;#39;t collect any money without getting a judgment first.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Reason #1: It costs $1000 or more to file a lawsuit in most states&lt;/strong&gt;. Between the attorney fees and court costs, it will cost a lender $1000 to $5000 to convert the debt into a judgment. The $5000 number is for people who fight them in court.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Reason #2: You can&amp;#39;t squeeze blood from a stone. &lt;/strong&gt;Most people short sell their house because of financial problems. The banks know this and have learned from past experience how hard it is to collect money from someone who is having financial difficulties.&lt;/p&gt;

&lt;p&gt;This is why the vast majority of all short sale sellers will never be sued by their lender after a short sale. &lt;/p&gt;

&lt;p&gt;Most garnishments have to be approved by a judge. If you can show the judge that you have kids to take care of, he may deny the garnishment.&lt;/p&gt;

&lt;p&gt;Alternately, you can show the judge that a garnishment would cause you serious financial hardship where you couldn&amp;#39;t afford gas to drive to work.&lt;/p&gt;

&lt;p&gt;The unfortunate news is that this is not true. In some states, state law forbids lenders from attempting to collect from a homeowner after a foreclosure or short sale. But those states are the exception, not the rule.&lt;/p&gt;

&lt;p&gt;Here&amp;#39;s what the Federal Mortgage Forgiveness Debt Relief Act does. It enables a homeowner to walk away from an upside-down debt without owing taxes on the loss.&lt;/p&gt;

&lt;p&gt;See, in the past a homeowner who was released from an upside-down debt would owe income taxes on the forgiven debt. This is called &amp;ldquo;Forgiveness of Debt Income.&amp;rdquo;&lt;/p&gt;

&lt;p&gt;This short sale expert said the following: &amp;ldquo;I read the Mortgage Debt Forgiveness Act, and it states that anyone who short sells a house will be released from the debt.&amp;rdquo; It&amp;#39;s sad that someone who considers himself a short sale expert would be so misinformed. So make sure you check out everything before you start the short sale process.&lt;/p&gt;

&lt;p&gt;The good news is that in most cases, a homeowner can short sale and walk away from the debt. But it doesn&amp;rsquo;t happen &lt;em&gt;every&lt;/em&gt; time.&lt;/p&gt;

&lt;p&gt;We&amp;rsquo;ve studied and analyzed all the short sale guidelines and rules. This was an FHA loan and therefore would be governed by FHA&amp;rsquo;s Short Sale Guidelines. This means the lender must follow FHA&amp;rsquo;s Specific Instructions on how to handle the short sale. Here&amp;#39;s what happened.&lt;/p&gt;

&lt;p&gt;&lt;a href="http://stopforeclosurehollister.info/short-sale.html"&gt;Click here to discover how other sellers successfully executed a short sale and avoided foreclosure.&lt;/a&gt;&lt;/p&gt;

&lt;p&gt;FHA sends all of lenders who handle its loans a letter called &amp;quot;Mortgagee Letter 2008-43.&amp;quot; It details exactly how the banks servicing an FHA loan are supposed to negotiate on a short sale.This letter is 16 pages long and gives specific directions on how much to pay agents, what percentage of the appraisal they can accept, etc.&lt;/p&gt;

&lt;p&gt;We had had a wretched experience on another FHA short sale. The lender lied to the seller&amp;#39;s prior agent and hadn&amp;#39;t followed the FHA Short Sale Guidelines. Because of that experience, we had read through this letter 2-3 times.&lt;/p&gt;

&lt;p&gt;Bottom line? We know a little bit about FHA&amp;#39;s rules for short sales. The problem was this negotiator at a large national bank didn&amp;#39;t want to follow the rules! Instead she made up her own rules!&lt;/p&gt;

&lt;p&gt;She told us the buyer and seller had to split the cost of the title insurance. The problem is that on page 12 of the Mortgage Letter, it says the lender is allowed to approve a file paying the standard title insurance costs.&lt;/p&gt;

&lt;p&gt;In our area, within the sale&amp;#39;s contracts it&amp;#39;s written that the seller pays for the title insurance. The buyer pays the closing costs and the title insurance for the lender.But this negotiator didn&amp;#39;t want to allow that. I had to argue back and forth with her for 2-3 days until she finally relented.&lt;/p&gt;

&lt;p&gt;FHA is insuring this lender against any and all loss on the loan. It has given that lender an almost risk-free way to make a decent profit on a mortgage. If they have given you specific instructions on how to negotiate a short sale, then follow those instructions!&lt;/p&gt;

&lt;p&gt;Here is the bottom line. If the negotiator at the lender is lying to you, then ask for the manager. When you talk to the manager, explain how the negotiator is breaking the rules. Tell them you may contact FHA and tell them that the lender is breaking the rules.&lt;/p&gt;

&lt;p&gt;To avoid a promissory note, you must convince the negotiator at the PMI Company that you have no assets and no disposable income that can be used to pay them.&lt;/p&gt;

&lt;p&gt;I ask to speak directly with the PMI negotiator. Don&amp;rsquo;t let your lender tell you that you&amp;#39;re not allowed to talk to the negotiator. Don&amp;rsquo;t take no for an answer. If necessary, ask to speak with a supervisor at the lender.&lt;/p&gt;

&lt;p&gt;The PMI companies know that if the home is foreclosed, they will lose even more money when the home is sold after foreclosure. Keep this in mind.&lt;/p&gt;

&lt;p&gt;Tell the employee that you will hold him accountable if the home is foreclosed and sells for less money after foreclosure.&lt;/p&gt;

&lt;p&gt;We have seen a lot of lenders and PMI Companies turn down short sales, only to see the property sell for much less after it is foreclosed upon.&lt;/p&gt;

&lt;p&gt;If you stick to your guns, they will release the debt and allow you to walk away without a promissory note.&lt;/p&gt;

&lt;p&gt;Here is how that happens. John gets a loan from ABC Bank. ABC Bank is running out of money to lend out, so it sells 1000 of its mortgages to Goldman Sachs.&lt;/p&gt;

&lt;p&gt;But how does that affect whether or not you will have a deficiency on a short sale? First, the majority of &amp;ldquo;Sliced and Diced&amp;rdquo; loans that we have short sold released the sellers from their deficiencies.&lt;/p&gt;

&lt;p&gt;This means the short sale approval letter said the homeowner was being forgiven of the debt. What about the people who are not specifically released from the deficiency?&lt;/p&gt;

&lt;p&gt;The good news is that the vast majority move on with their lives and never hear anything more from their lenders. Time moves on, and they forget about the debt.&lt;/p&gt;

&lt;p&gt;After a few years the statute of limitations kicks in and they are home free. Their lender no longer has the right to collect the money from them.&lt;/p&gt;

I haven&amp;#39;t heard of another loan program where they specifically stipulate that you must be behind on the payments before they will consider a short sale.&lt;/p&gt;

&lt;p&gt;The good news is that USDA&amp;#39;s short sale guidelines state that you won&amp;#39;t have a deficiency after completion of a short sale. Here is the text from their short sale guidelines:&lt;/p&gt;

&lt;p&gt;&amp;quot;A borrower who successfully sells the property securing the loan using the Pre-Foreclosure Sale Option is relieved of the mortgage obligation. The borrower shall not be pursued for deficiency judgments by either the Servicer or the Agency.&amp;quot;&lt;/p&gt;

&lt;p&gt;This is good news for anyone who has a USDA loan and wants to get out from under her upside-down mortgage.&lt;/p&gt;

&lt;p&gt;On your original mortgage, 1-4 pages past the signature page will be a VA Rider. At the top it will say &amp;quot;NOTICE: THIS LOAN IS NOT ASSUMABLE WITHOUT THE APPROVAL OF THE DEPARTMENT OF VETERANS AFFAIRS.&amp;quot;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;That is a VA loan.&lt;/strong&gt; The picture above is from a VA mortgage. The page for the VA mortgage was 2 pages below the original signature page of the mortgage. The pages between this and the signature page had the notary&amp;#39;s signature and the legal description. You can get a copy of your mortgage from the public records in your county.&lt;/p&gt;

&lt;p&gt;Most Realtors will know how to look up this information. If not, they will know a title company that can do the research for you.&lt;/p&gt;

&lt;p&gt;A VA Short Sale is called a &amp;quot;Compromise Sale.&amp;quot; According to those guidelines, the VA will give a complete release if a seller participates in the short sale program and there was no &amp;quot;fraud, misrepresentation, or bad faith&amp;quot; on the part of the homeowner.&lt;/p&gt;

&lt;p&gt;The bad news is that you will not be eligible for another VA loan until you repay the VA for its loss. So you may not be able to get a VA loan in the future.&lt;/p&gt;

But how do you determine whether or not you have an FHA loan?&lt;/p&gt;

&lt;p&gt;Here is the best way I have found to do this. Look up your mortgage in the public records in your county. You can usually access the public records online. Just Google, &amp;quot;County, State Public Records.&amp;quot; For example, if we Google &amp;quot;Cook County Illinois Public Records,&amp;quot; then you will get the clerk of court&amp;#39;s website on the second link.&lt;/p&gt;

&lt;p&gt;Most realtors will know how to look up this information. If not, they will know of a title company that can do the research for you. Once you access the public records, you will want to pull up your mortgage.&lt;/p&gt;

&lt;p&gt;If you have an FHA loan, then on the first page of the mortgage there should be a small square; inside the square it will say &amp;quot;FHA Case Number 091-4242640-703.&amp;quot;&lt;/p&gt;

&lt;p&gt;FHA&amp;#39;s Short Sale Guidelines are covered in a letter it sends out to all the lenders handling its loans. Whenever FHA makes a change to the guidelines, it sends out a Mortgagee Letter.&lt;/p&gt;

&lt;p&gt;For instance, the FHA issued a new Mortgagee Letter at the beginning of the financial crisis that made a lot of changes to how it handles short sales. That letter was called &amp;quot;Mortgagee Letter 2008-43.&amp;quot;&lt;/p&gt;

&lt;p&gt;Here is an excerpt from the letter:&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&amp;quot;Mortgagors, acting in good faith, who successfully sell their properties using this option are relieved of their mortgage obligation &lt;/strong&gt;and are entitled to a consideration of $750.  If the closing occurs within 3 months of the approval to participate, the mortgagor will be entitled to $1,000. Unless the mortgagor&amp;rsquo;s consideration is required to release junior liens, the mortgagor may elect to accept cash paid at closing.  The mortgagor may also apply a portion of or the entire amount of consideration to offset sales costs not paid by HUD; including a home warranty plan fee, costs of optional repairs, and buyer&amp;rsquo;s closing expenses.  &lt;strong&gt;If the PFS is unsuccessful and foreclosure occurs, mortgagors who participate in the PFS Program in good faith will not be pursued for deficiency judgments by the mortgagee or HUD.&amp;quot;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;The main requirement to be allowed to participate in the program is that the property cannot be an investment property and that the homeowner has to have a genuine hardship.&lt;/p&gt;

&lt;p&gt;Looks like a good way to wipe out some upside-down mortgage debt.&lt;/p&gt;

&lt;p&gt;I&amp;rsquo;ll call them Fannie and Freddie in this post. Freddie and Fannie are different quasi-governmental entities that own mortgages. For our conversation, they are very similar in the way they handle short sales.&lt;/p&gt;

&lt;p&gt;First, you need to find out if Fannie or Freddie owns your loan. Fannie Mae has a website with a lookup tool. Go to this site to research if your loan is owned by Fannie Mae: &lt;a href="http://www.fanniemae.com/loanlookup/"&gt;www.fanniemae.com/loanlookup/&lt;/a&gt;. Freddie Mac has a lookup tool here: &lt;a href="https://ww3.freddiemac.com/corporate/"&gt;ww3.freddiemac.com/corporate/&lt;/a&gt;.&lt;/p&gt;

&lt;p&gt;If your loan is owned by Fannie Mae, you usually do not have to worry about a deficiency. Fannie Mae&amp;rsquo;s official policy is that it will forgive the debt if a seller has a genuine hardship.&lt;/p&gt;

&lt;p&gt;Fannie and Freddie&amp;rsquo;s policies are basically the same. They state that they will pursue a short sale seller if they think the homeowner can afford to make the payment or it is an investment property.&lt;/p&gt;

&lt;p&gt;You need to keep this in mind if you are strategically defaulting. One problem with some of these short sales is that the loan was insured by Private Mortgage Insurance, also called PMI.The PMI companies have the ability to approve or veto the short sale offer.&lt;/p&gt;

&lt;p&gt;Many PMI companies ask for a promissory note before they will approve a short sale. The good news is that the promissory note is usually less than the amount lost.&lt;/p&gt;

&lt;p&gt;For example, we recently saw a lender lose over $100,000 on a short sale. The lender asked the homeowner for a $20,000 promissory note. Are you willing to pay $20,000 to walk away from $100,000 in debt? I think that&amp;rsquo;s a good bargain.&lt;/p&gt;

&lt;p&gt;If you have a Fannie or Freddie Loan and have a genuine hardship, then you can be pretty confident that you have a very good shot at being able to walk away without a deficiency.&lt;/p&gt;

&lt;p&gt;Many agents will tell you that you won&amp;rsquo;t know for sure if you will have a deficiency until you have started the short sale process. Sure, they can give you the answer if you are in a nondeficiency state such as California.&lt;/p&gt;

&lt;p&gt;But what if you&amp;#39;re in Florida, which is a deficiency state? They will usually tell you that you won&amp;rsquo;t know if you will have a deficiency until the short sale process has been started.&lt;/p&gt;

&lt;p&gt;That is not necessarily true. First, here is the good news. In about 80-90% of all cases, you will not have a deficiency on a short sale even if you live in a deficiency state.&lt;/p&gt;

&lt;p&gt;But if your loan is the type that does not require deficiencies, then you don&amp;rsquo;t have to worry about a deficiency. The key is to find out the type of loan you have and the short sale guidelines for that type of loan.&lt;/p&gt;

&lt;p&gt;In my next post I will start to explain those different loan types and their short sale guidelines.&lt;/p&gt;

She was thinking about a short sale but was worried about a deficiency.&lt;/p&gt;

&lt;strong&gt;Here is a sentence from her email:&lt;/strong&gt; &amp;quot;We obviously want to get the price as close to fair market value as possible to eliminate or reduce any deficiency the bank may assess, but we also want the house to move as quickly as possible.&amp;quot;

&lt;p&gt;Here is the good news for Joy. In about 80-90% of all cases, the homeowner is allowed to walk away without a deficiency. Yes, banks are releasing homeowners from hundreds of thousands of dollars in upside-down debt.&lt;/p&gt;

&lt;p&gt;We&amp;#39;ve seen homeowners walk away from $300,000, $500,000, and more in upside-down debt. It&amp;#39;s like a &amp;quot;Get Out Of Jail Free&amp;quot; Card.&lt;/p&gt;

&lt;p&gt;So, how do you find out if you will not owe a deficiency after a short sale? Here is the first step. Find out who owns your loan. Even if you send your monthly payment to ABC Bank, it&amp;#39;s likely that your loan is owned or insured by one of the one of the following entities.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fannie Mae or Freddie Mac.&lt;/strong&gt; There is about a 60% chance that your loan is owned by one of these two entities. If they own your loan, then mortgage forgiveness will be granted according to their policies.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;FHA Insured.&lt;/strong&gt; FHA does not own your loan, but it insures the owner against loss--which means it will be writing the check for the loss. As a result, it dictates whether or not the debt is forgiven.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;VA Insured.&lt;/strong&gt; The Veteran&amp;#39;s Administration does not own your loan, but it insures the owner against much of the loss. As a result, it dictates whether or not the debt is forgiven.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;USDA Insured.&lt;/strong&gt; USDA does not own your loan, but it insures the owner against much of the loss. As a result, it dictates whether or not the debt is forgiven.&lt;/p&gt;

&lt;strong&gt;Sliced and Diced Loan.&lt;/strong&gt; This is a mortgage that has been securitized.&lt;strong&gt; &lt;/strong&gt;It is called &amp;quot;Sliced and Diced&amp;quot; because of the way the ownership of each loan is sliced up and sold off to thousands of different people. &lt;strong&gt;&lt;/strong&gt; The actual owners of the loan are the people who bought the securitized loan product.

&lt;p&gt;Once you have found out who owns your loan, you move to the next step. That is to find out the short sale deficiency guidelines of the individual owner or insurer of your mortgage.&lt;/p&gt;

&lt;p&gt;If your house has had a 40% drop in value, you shouldn&amp;rsquo;t be paying a mortgage payment based on a value of $500,000. You should be paying a mortgage payment based on a value of $300,000. Make sense?&lt;/p&gt;

&lt;p&gt;Here&amp;#39;s how to find calculate you should be paying. Using the Google &amp;quot;amortization calculator,&amp;quot; type in what your home is currently worth. Enter the interest rate you were originally paying.&lt;/p&gt;

&lt;p&gt;Look at the example numbers below.&lt;/p&gt;

&lt;p&gt;* A $500,000 mortgage at 6% interest is a monthly payment of $2997.75.&lt;/p&gt;

&lt;p&gt;* A $300,000 mortgage at 4.5% interest is a monthly payment of $1520.06. Remember, interest rates have dropped a bunch lately.&lt;/p&gt;

&lt;p&gt;It looks to me like this person is overpaying by $1477.69 a month. Ouch!&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Run the numbers for your house.&lt;/strong&gt; If your lender forecloses on your house, then it&amp;rsquo;s not necessarily going to sell for the market value. Most foreclosed houses often sell for 85% to 95% of the value today.&lt;/p&gt;

&lt;p&gt;Remember, knowledge is power. When you have this information, you have a much better negotiating position with your lender. You can say, &amp;quot;Hey guys, foreclose on my house. But be prepared to lose a ton of money.&amp;quot;&lt;/p&gt;

All that does is make it harder for someone responsible to get a loan. &lt;p&gt;But let me ask you this. I met a homeowner named John. John&amp;#39;s company went under during the economic crisis, and John lost his job. He was out of work for six months and burned up all his savings and retirement accounts trying to stay afloat.&lt;/p&gt;

&lt;p&gt;Today John is working two jobs but making less money than he did at his previous one job. He cannot afford his mortgage payment. His lender will not reduce the payment to where he can afford it. If he pays the mortgage, then he can&amp;#39;t pay for groceries. He makes too much money to qualify for food stamps.&lt;/p&gt;

&lt;p&gt;So what should he do? Should he get a third job, work until he burns out, and then lose everything? Or should he move to a more affordable house and try to get his life back on track?&lt;/p&gt;

&lt;p&gt;I think he should do whatever he can to get his life back on track, whether that be a loan modification or short sale. I know you may think he should work 80 or 100 hours a week until he has repaid every single debt in full.&lt;/p&gt;

&lt;p&gt;Ultimately John and his family have to do what makes sense for them. Fortunately, America gives you the freedom to make your own decisions on what is best for you.&lt;/p&gt;

&lt;p&gt;Today he is paying $4400 monthly. The sad thing is that it would cost him about $2500 a month to rent a comparable home. He could save $1900 monthly if he moved out and rented a similar home.&lt;/p&gt;

&lt;p&gt;Even worse is how much money this will cost him over the long term. I project it will take 19 years for his house to appreciate back to what he originally paid for the residence. He will overpay his lender by $433,200 over the next 19 years while he and his family wait for the housing market to recover.&lt;/p&gt;

&lt;p&gt;It&amp;#39;s sad, but the only way I have seen people receive a principal reduction is to short sell their houses.&lt;/p&gt;

&lt;p&gt;You can even buy another house right away if you qualify for the guidelines of certain short sale programs.&lt;/p&gt;

&lt;p&gt;Guess what happens next? You&amp;#39;re going to be stuck with a much higher monthly payment. Make sure that when you start negotiations, you know the alternatives. You can&amp;#39;t negotiate unless you come from a position of power.&lt;/p&gt;

&lt;p&gt;You must be able to say, &amp;quot;I can afford to walk away from the negotiating table if you push me to hard. If the bank pushes me to a monthly payment that I can&amp;rsquo;t afford, then I will walk away and get a better deal for myself elsewhere.&amp;quot;&lt;/p&gt;

&lt;p&gt;Find out for how much houses similar to yours are renting. It might make sense to rent and divorce the unrealistic lender and overpriced mortgage.&lt;/p&gt;

&lt;p&gt;I&amp;rsquo;ve seen so many people stay in their houses and accept monthly payments much higher than for what they could rent a similar home each month.&lt;/p&gt;

&lt;p&gt;The other thing is, they&amp;rsquo;re already strapped just trying to pay their mortgage month. It becomes a struggle to put food on the table. How did that happen? Well, their lender was good at negotiating. Don&amp;rsquo;t let someone who&amp;rsquo;s good at negotiating push you around and take food off your table.&lt;/p&gt;

&lt;p&gt;As a result, people are stuck overpaying for their upside-down homes. Take an example of a family that bought its home at the peak of the market with a monthly payment of $1400.&lt;/p&gt;

&lt;p&gt;Their lender agreed to forgive their missed back payments but wouldn&amp;#39;t reduce the monthly payment. So, this family started looking at other options.&lt;/p&gt;

&lt;p&gt;The family had recently had a first child and wanted to move out of a townhouse to a house with a yard. They found a bigger home with a large yard for their daughter.&lt;/p&gt;

&lt;p&gt;The new home even had a two-car garage that the townhouse didn&amp;#39;t. They liked the new home, but they liked the payment even better. The rent payment was $850 a month.&lt;/p&gt;

&lt;p&gt;That&amp;#39;s a 39% reduction in their monthly payment. Even worse, it would have taken 25 years for their house to be worth what they had paid for it.&lt;/p&gt;

&lt;p&gt;Let&amp;#39;s say they had accepted their lender&amp;#39;s offer and agreed to pay $1400 a month. According to my calculations, they would have paid their lender $165,000 extra above what they pay for rent.&lt;/p&gt;

&lt;p&gt;They are friendly and fun to work with. This is one of the things I like about selling short sales for a living. The downside is that every once in a while, a negotiator will get an attitude.&lt;/p&gt;

&lt;p&gt;For whatever reason, they have decided to go on a power trip. They start asking for unnecessary paperwork. or they nitpick the paperwork you send to them.&lt;/p&gt;

&lt;p&gt;Most agents just kowtow to the negotiator. They think the negotiator has all the power. I have found that isn&amp;#39;t true. The negotiator has very limited power.&lt;/p&gt;

&lt;p&gt;After all, they don&amp;#39;t own the bank. They aren&amp;#39;t the ones who will be losing money on the loan. The fact is that most banks lose a substantial amount of money when they turn down a short sale.&lt;/p&gt;

&lt;p&gt;As an example, a bank turned down a $190,000 offer on a short sale. The property sold about 18 months later. But this time it didn&amp;#39;t sell for $190,000; it sold for $165,000.&lt;/p&gt;

&lt;p&gt;Not only did that bank lose $25,000 on the sales price, but it also paid the property taxes and insurance for that amount of time. In addition, the bank was unable to lend that money and earn interest.&lt;/p&gt;

&lt;p&gt;I estimate the bank lost an additional $15,000 when you factor in the interest. That&amp;#39;s a $40,000 loss.&lt;/p&gt;

&lt;p&gt;When a short sale negotiator gets an attitude, I simply remind him of this. I also tell them I will be holding him accountable if he turns down the short sale and the bank loses more money as a result. Needless to say, negotiators lose the attitude.&lt;/p&gt;

&lt;p&gt;Now, let&amp;#39;s add up the cost of home ownership. First, you have the monthly mortgage payment. Add in home insurance, property taxes, and any Homeowner&amp;#39;s Association Fees.&lt;/p&gt;

&lt;p&gt;Now subtract out the tax savings. To calculate that, take what you&amp;#39;ll be paying monthly for interest and property taxes. Multiply that by your combined state and federal tax rate. That is your projected tax savings.&lt;/p&gt;

&lt;p&gt;&amp;quot;I have owned my house since 2006. My employer reduced my salary by 30%, and now I have to move out of state where I have found a new job. The house is a problem. Since 2006 my house price has dropped by about $40,000, that means I have a $40,000 deficiency, which I don&amp;#39;t want to pay. I have option to rent the house, but I am still considering a short sale. Any advice? ~ Sergio.&amp;quot;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Here was our answer to Sergio&amp;#39;s question:&lt;/strong&gt; Sergio, I would attempt a short sale. Depending on your situation and the type of loan you have, more than likely you will not have a deficiency.&lt;/p&gt;

&lt;p&gt;I can give you a better answer after I get more information from you. I wouldn&amp;#39;t recommend renting the house. How hard is it going to be to manage when you are out of state? What if the tenants stop paying? What if a pipe breaks and floods the house?&lt;/p&gt;

&lt;p&gt;I&amp;#39;m not saying don&amp;#39;t rent the house. I just know from past experience that managing rental property from a distance is super tough.&lt;/p&gt;

&lt;p&gt;I knew a real estate investor who targeted what he called &amp;quot;tired, out-of-town landlords.&amp;quot; He would offer to buy their property below market. Surprisingly, many of them accepted his lowball offers because they were so tired of dealing with the property.&lt;/p&gt;

&lt;p&gt;Here is the other downside on renting. You will probably have negative cash flow every month. I don&amp;#39;t know what your house will rent for. But if you are upside down on your house value, then you are likely also upside down on the rental value. That means you will almost certainly lose money on the rent every month.&lt;/p&gt;

&lt;p&gt;With your precarious financial situation, recent 30% salary cut, and move out of state, the last thing you need is another bill each month. With a short sale you can walk away owing nothing, with no tax liability, and be eligible to buy another house in three years. That sounds a lot better to me than being stuck with a money-losing house two years from now.&lt;/p&gt;
